1.1 Ultimate Nutrition Ltd is registered in England. Materials on this site are directed solely at those who access it within the UK mainland. Those accessing this site from other locations are responsible for compliance with local laws if applicable. You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement. If any provision of this Agreement shall be unlawful, void pr for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. English Law shall govern this Agreement.
2.1 Reasonable care has been taken by Ultimate Nutrition in the design, layout and content of this site. However, to the extent permitted by applicable law, Ultimate Nutrition disclaims all warranties, express or implied, as to the accuracy of the information contained in any materials within this site.
2.2 Ultimate Nutrition shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained within this site.
2.3 Links within this site will lead to sites which are not under the control of Ultimate Nutrition. When you activate these you will leave the Ultimate Nutrition site, Ultimate Nutrition will not accept any responsibility or liability for the material on any other site as Ultimate Nutrition as not control over any other site.
3.1 You agree that Ultimate Nutrition shall not be liable either in contract, tort, negligence, statutory duty or otherwise for any:
3.2 loss of profits, goodwill, revenue or any type of consequential, indirect or special loss or damage whatever arising from or in any way connected with this Agreement
3.3 direct damage or loss, including damage or loss which is reasonably foreseeable or occurs naturally in the course of things, resulting in any acts, omissions, failures or delays occurring to, on or in relation to those parts of the Internet not under Ultimate Nutritionís direct control, including, without limitation, loss or damage of business, loss of sales, non payment of monies due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss, even where Ultimate Nutrition has been advised of the possibility of such damage or loss.
3.4 You agree that, except in relation to such liability as has been expressly excluded in clause 3.1, the maximum aggregate of liability of Ultimate Nutrition in contract, tort, negligence, statutory duty or otherwise, even where Ultimate Nutrition has been advised of the possibility of such damage or loss, for any damage or loss arising from or in any way connected with:
3.4.1 any defect in a product
3.4.2 any failure by Ultimate Nutrition to process signals, data, information, orders or messages correctly or in a timely manner, or any misrouting or non delivery of signals, data information, messages or orders from you to other persons or from other persons to you, or any scrambling or distortion of data or information contained in them, and any liability not excluded by this Agreement shall, in respect of any one or more events or series of events, connected or unconnected, taking place within any twelve month period be limited in the case of defects falling within clause 3.4.1 to the price of the relevant goods. This limit shall also apply in the event that any exclusion or other provision contained within this Agreement is held to be invalid for any reason and Ultimate Nutrition becomes liable for damage or loss that could otherwise have been limited.
3.5 You agree and acknowledge that you are in a better position than Ultimate Nutrition to foresee and evaluate any potential loss or damage that you may suffer in connection with the goods and services provided by Ultimate Nutrition, and therefore that Ultimate Nutrition cannot adequately insure in respect of such liability. You warrant to Ultimate Nutrition that you will insure against, or bear yourself, any loss for which Ultimate Nutrition has excluded liability
3.6 Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some limitations set out in clause 5 may not apply to you.
3.7 Nothing in this Agreement shall effect the statutory rights of any customer, exclude or restrict any liability for death or personal injury arising from negligence or fraud of Ultimate Nutrition
4.1 Save to the extent that it falls within the provision of clause 5 you shall indemnify Ultimate Nutrition and any third party, including its sub contractors, from and against any liability, losses, rights expenses, loss of profits, business interruption, consequential loss, pecuniary loss, claims or legal proceedings, including, but not limited to claims involving defamation and intellectual property infringement and expenses, including legal charges, arising from your use of the Ultimate Nutrition site or purchase of goods/services from that site which are brought or threatened against Ultimate Nutrition or suffered or incurred by Ultimate Nutrition by another person or entity.
24 hour delivery - the order must be placed before 10.30am to be eligible for dispatch that same day for delivery 24 hours later (the next working day, Monday-Friday).
5.1 We aim to deliver as stated on the site or in the Ultimate Nutrition information. However delivery days quoted are expected delivery dates only. Ultimate Nutrition shall not be held liable for any delays caused except to the extent caused wilfully or negligently by Ultimate Nutrition.
5.2 There will be an additional carriage fee for customers ordering outside the UK, and outer most areas in Scotland. This charge you will be advised of on your first order, thereafter accepted as confirmed, prior to Ultimate Nutrition taking payment except for Eire and Northern Ireland where there will be an additional £5.00 taken on top of the gross figure of your order to send over to these two places. The order will not be processed until your authorisation has been received.
5.3 National Shipping
We currently offer national deliveries via Royal Mail, Interlink Express and Interparcel and can offer other courrier services including ParcelForce at a rate to be negotiated at time of ordering.
Via Royal Mail
We offer an economy service using Royal Mail for anything up to 960g. The price is decided on the total weight of the order and there are 16 price bands.
Items can be sent using recorded delivery so a signature is required and can take 1-4 working days to arrive. Please note the maximum compensation for loss of goods is £28 and the package must be missing for 15 working days from the date sent. You cannot track this parcel.
Via Courier Service
We are able to ship parcels via courier, currently Interlink Express to the UK mainland*; this is an express delivery next working day. Parcelforce 24 is also next working day and Parcelforce 48hr can take 1-3 working days (this is dependent on if the order needs to be made to order) and there will be a 24 hour delivery charge on top of our normal UK charge.
The tracking number can be obtained by contacting 01995 641008 which will be known once your order has been dispatched. With Interlink Express a tracking number will be provided to your email address.

(Please note slight delays can sometimes be expected after at busy times due to the nature of our business and that of the couriers business. All orders are blended to order. Any orders made on any given day won't be processed until the following day.)
Please note all lost/stolen deliveries must be reported to us within 14 days of the order date so we can claim against the loss.
*Please note ANY deliveries to non-mainland UK (Scottish Highlands) or a BFPO address is NOT classed as UK mainland by Yodel and an alternative service may have to be sourced for such consignments

International Airmail (Recorded)
This is the cheapest insured method of having your goods sent internationally. The maximum compensation for loss/damage is £30. All items must be signed for. Deliveries are made typically within 7 days, but can take up to 28. The maximum weight that can be sent with this service is 1.8kg.

For the quickest delivery possible we can send your order via ParcelForce International. Your order will be fully insured against loss or damage and delivered within 3-4 working days. A signature is required on delivery. Please note we take no responsibility for any custom fees or problems with your products being seized by customs. You order at your own risk.
Saturday delivery subject to current prices and will be charged to your paymet card if you require this service.
All ingredients/supplements are supplied either in tamper proof wide-neck containers or pouches - ideal for sports supplements as they are extremely easy to access and can be clicked shut to make them airtight - or bagged in food-grade plastic bags and sealed & boxed. When ordering you have the choice of which packaging you would prefer.
All product images are of the tubs we use. Dependent on the size of your order we may use different styled tubs, but they are all the same high quality and suitable for food usage.
Some items may be hygroscopic and this may cause 'clumping' during shipment. This does not affect the efficiency of the product, just the texture/appearance.
All deliveries are then packaged in custom made cardboard boxes to ensure your order arrives to you in perfect condition.
Our Returns Policy
Any issues with the order must be reported within 24 hours of receiving the product.
No unauthorised returns.
No returns on products that have been opened.
No shipping charges will be refunded.
Any damaged product must be received by us before we can release any credit or product(s) reshipment.
All returns are subject to a 25% restocking fee (this does not include damaged goods). £5.50 re-delivery charge.
None of the above affect your statutory rights.
6.1 All pictures, photographs, text, design and layout of the Ultimate Nutrition site remain the copyright of Ultimate Nutrition. You may print portions of the Ultimate Nutrition site for your personal and non commercial use.
6.2 Use of any content of the Ultimate Nutrition site is strictly prohibited without prior written consent of Ultimate Nutrition and its Director.
7.1 Should a Product price be listed incorrectly due to a typographical error we reserve the right to refuse to meet or cancel any orders placed for that product. We will aim to contact you on a daytime telephone number so please ensure you do leave this contact number when placing orders.
8.1 We reserve the right to supply any alternative flavour should you not state a flavour preference at time of order. If this is not acceptable goods would have to be returned to us as per clause 8.2.
8.2 Goods returned due to flavour not being stated at time of order, we reserve the right as per clause 8.1, is the responsibility of the customer. Customers may exchange the flavour with a further handling charge of £5.50 for Ultimate Nutrition to despatch the replacement product.
9.1 Ultimate Nutrition shall not be held liable for any breach of this Agreement caused by circumstances beyond its control, but not limited to Acts of God, fire, lightening or extremely severe weather conditions, explosions, war, disorder, floods, industrial disputes, whether or not involving our employees, acts or omissions of internet service providers or acts of local or central Government or other competent authorities.
10.1 In the event that any term of this Agreement is held to be invalid or Unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.
1. Ultimate Nutrition Whey Isolate 90%, Ultimate Mass Gain 4000, Ultimate Whey 80% are professional dietary foods and will only be refunded if unopened and returned within 14 days of initial order. The whole product to be returned at the customers expense.
2. For product purchased on deals: 2+1 free offers, as an example: If you genuinely are not happy with the product, you will be offered a refund based on the products returned. If 2 packs + the free one are returned a full refund will be offered (subject to clause 1, 4, 6). If however, one pack is returned from the 2+1 offer, you will be refunded a proportion of the total cost of your order for that product (less £5.00 p&p). Please ensure that you do not break the seals and/or remove any tablets, capsules, or servings from each pack. If you do only the sealed packs will be refunded as a proportion.
3. Refunds can only be honored if ordered through our mail order section or through www.ultimate-nutrition.co.uk site. Stockists of Ultimate Nutrition are not obliged to offer the same guarantee.
4. £5.50 p&p & £5.00 for administration will be deducted from all refunds if the fault is not Ultimate-Nutrition.
5. Customers orders that are returned to us as not being collected from the couriers depot, orders refused on delivery, ordered by mistake, customers change of mind or on a Doctors say so, if in doubt check with your practitioner first, will be subject to a handling fee and re-sending fee of £15.00.
6. Products, packaging and remaining contents returned must be received by us within 7 days from invoice date. We suggest you send your products to us by recorded, special or Proof of Delivery service as we cannot be held responsible if your carrier loses your parcel.
7. Out of date products will not be refunded upon.
